Under art. 13 of the EU Regulation 2016 679/EU (hereinafter, for the sake of brevity, "Regulation") Carpigiani Group – Ali Group S.r.l. e Antherica S.r.l., in their capacity as Joint Data Controllers, inform you that your data will be processed in the following ways and for the following purposes.

Nature of personal data

The processing activities will concern general personal data and will be limited to those that are strictly relevant to and necessary for the purposes pursued.

Purpose of the processing

The processing of data will have the following purposes:

(A) managing your application for registration to the platform by the Joint Data Controllers;

(B) managing any purchase order for products and/or services offered by the Joint Data Controllers;

(C) direct marketing (i.e. activities aimed at processing statistics and market research, sending you informative material, as well as surveys to improve the service) by the sole Joint Data Controller Carpigiani Group - Ali Group S.r.l., which will also send you a reminder, after 24 hours, in the event that the shopping cart to which you have added products is suspended, so as to provide you with a specific link for recovery. Such communications may be made via automated messages or emails;

(D) send newsletters, commercial communications and/or information and advertising material on products or services offered or events promoted or organized by email, mail and/or telephone;

(E) customize commercial or informative communications on products or services offered (profiling).

Legal basis of processing operations

The legal basis for processing, for the purpose referred to in letter A), D) and E) is consent; for the purpose referred to in letter B) is the contract; for the purpose referred to in letter C) is the legitimate interest of the Joint Data Controller Carpigiani to inform users interested in its products and customize the service according to their needs.

Nature of data provision and consequences of refusal

The provision of personal data is necessary for the processing made for the purposes referred to in letters A) and B) and any refusal, in whole or in part, or an inaccurate or untrue provision, will result in the inability of the Joint Data Controllers to proceed with your registration on the platform and any subsequent purchase order of products and/or services offered.

To the contrary, with reference to the purposes referred to in points C) and D), data provision is optional and refusal to do so will result in not being able to use the newsletter service, i.e. only receive customized communications.

Method of processing

The processing of personal data may concern all the operations indicated in art. 4, number 2) of the Regulation. In any case, the limits and principles of correctness, lawfulness, purpose, quality, relevance, non excess and transparency will be respected.

Personal data will be processed with automated tools for the time strictly necessary for the purposes for which they were collected and will be stored in electronic archives.

The processing will be carried out directly by the Joint Data Controllers’ organization. In any case, the data will be processed with logics strictly related to the purposes indicated and with methods that ensure their security and confidentiality, through the adoption of appropriate measures to prevent alteration, deletion, destruction, unauthorized access or processing not allowed or not in accordance with the purposes of collection. 

Data disclosure

The data will be disclosed to third parties such as distributors and/or dealers of Carpigiani machines, as well as companies with which the Joint Data Controller Carpigiani Group – Ali Group S.r.l. maintains business relationships.

Duration of processing and storage period

The personal data voluntarily provided by the data subject when registering on the website will be processed by the Joint Data Controllers for as long as the e-commerce service is in place, unless the user proceeds to deactivate the account. In the event of non-use of the website, the Joint Data Controllers will delete the user's account and related data ten years after the last access to the platform. Personal data contained in purchase orders placed will be retained for a period of ten years after the conclusion of the contract. Personal data processed for direct marketing purposes will be processed for a period of 24 months, unless you deactivate or delete your account or exercise your right to object to processing.

With regard to using email, mail, and/or telephone contacts to send newsletters, commercial communications, and/or informative and advertising materials for products or services offered or events promoted or organized and possible customization of the communications themselves, the data will be processed as long as the service is active.

Rights of data subjects

You may at any time exercise your rights:

a) to access to personal data;
b) to obtain their rectification or deletion or to limit their processing;
c) to object to the processing;
d) of data portability;
e) to withdraw consent: the withdrawal of consent shall not affect the lawfulness of processing based on the consent given before the withdrawal;
f) to make a complaint to the supervisory authorities (Personal Data Protection Authority).
